This website is owned and operated by: Touraloora, with a registered address at Hollywell, Roscommon, Co. Roscommon, Ireland.

Terms

“We”, “our” and “business”, when used below, refer to Touraloora.

“Customer” and “you”, when used below, refer to the party who has made the payment (whether full or deposit) for a tour or other event and others who accompany them under the same booking.

All bookings with Touraloora are subject to the following terms and conditions. Your statutory rights are not affected.

Bookings

“One-day tour” means guests gather for an event and depart the completed event on the same day.

“Weekend tour ” means guests gather on day 1 and depart on day 2, 3, 4 or 5, depending on the duration of the particular event.

“Longer tours” typically means an event where people gather on day 1 and depart on day 6, 7 or 11 depending on the duration of the particular event.

In the case of one-day and weekend events, a booking is deemed to have been made when Touraloora has received the full fee due.

In the case of longer tours, a provisional booking is deemed to have been made when Touraloora has received the appropriate booking deposit. Note, however, that such a booking is subject to the full payment of all outstanding balances by the date outlined in the particular tour’s description in email communication forwarded by Touraloora upon receipt of said deposit.

A 25% non-refundable deposit is required to secure multi-day tour dates and vehicle.  The remaining 75% payment to be made more than 90 days prior to the tour date.

Full payment is to be made if the booking is within 90 days of the tour date. We will send you written confirmation of your booking and ask you for your confirmation of accuracy. Once you have confirmed all is in order this will then act as a binding contract between us which will be governed by the laws of Ireland and subject to the exclusive jurisdiction of the Irish courts.

Cancellation

If full payment is not received on time (more than 90 days before the tour date) we reserve the right to treat the booking as cancelled. The deposit is forfeited if a booking is cancelled more than 90 days before the tour date.

If 56 days or less notice is given, or, in the event of a no-show there will be a full charge.

Should you wish to cancel your confirmed booking, the person who made the booking must advise Angela Gavigan.

Full payment for one-day and weekend events is due at the time of booking.

While we always aim to operate all of our tours as advertised, we reserve the right to modify or cancel any tour before its start date.

In the event that we have to cancel a tour, the customer shall receive a full refund of the monies paid to us but will not be entitled to any further sum by way of compensation, damages or otherwise, arising from said cancellation. This applies no matter when the tour is cancelled.

Where our tours are dependent upon a minimum number of customers, if the minimum number of customers has not been met prior to the start date, we are entitled to cancel the event. In such circumstance, all monies paid to Touraloora shall be refunded to the customer.

However, the business is not responsible for any additional expenses that may have been incurred by the customer in preparing the trip. Examples might include where you have booked accommodation for the night prior to or following the cancelled event. Please note especially regarding overseas trips, where the customer pays for his/her flights directly with an airline, that his/her contract for transport to the overseas destination is with the airline or travel agent and not with Touraloora.

Payment

Payments may be made by bank transfer using Stripe, wire or credit/debit card.  We accept all major cards.  Touraloora are not liable for any bank charges associated with credit/debit payments or bank transfer/wire.  Please inform your bank of the payment details prior to payment so that transaction is not prevented by your bank.

All events are priced in Euro and where a customer pays from an account in another currency, it is their responsibility to ensure the correct Euro amount reaches the bank account of Touraloora.

All tour bookings are subject to our Terms and Conditions of Hire and a Contract which sets out our responsibilities to each other.  The person making/paying/signing the booking form is responsible for signing on behalf of the group.

Payment Service Fees Deduction

Please note that all refunds will have payment system service fees that had been charged to Touraloora deducted. This amounts to approximately 3% of the fee the customer had paid. For example, a booking of €600 will typically be refunded approximately €582, while a deposit of €400 will be refunded approximately €388. These examples are indicative and non-binding, as the third-party payment systems used on this website may, at any time, change their commission rates.

Force Majeure

Where war or terrorist activities, threatened or actual, civil unrest, virus or other disease, industrial action, threatened or actual, weather conditions, fire, flood, drought, airport regulations or closures, unforeseen alterations to public transport schedules and rescheduling of aircraft, government advice, instruction, moratorium or regulation on travel, or any other event outside the control of Touraloora either delays or extends the tour or compels a change in prior arrangements, the business cannot accept liability for any resulting loss, damage or expense to the customer.

Insurance & ‘Touraloora’ Liability to the Customer

Although we take the greatest care to ensure that everything runs smoothly during our events, accidents can happen.

It is essential that you are adequately insured to cover medical expenses, loss or damage to/of personal property, injury, death, repatriation, cancellation and curtailment.

For this reason, you should take out adequate insurance cover prior to travel. Please note that Touraloora cannot accept any liability relating to personal injury or illness, loss or damage to personal equipment, or any other unforeseen events that occur during your tour.

Note that Irish and other EU citizens travelling within the EU are entitled to a European Health Insurance Card (EHIC), which simplifies the procedure when receiving medical assistance during their stay in a member State.

The EHIC (commonly referred to by its old name, the E111) entitles the holder to the same treatment at the same cost as a national of the country where medical assistance is required. Presentation of the EHIC guarantees reimbursement of the medical costs. In the event of treatment being required, the card should be presented at the earliest opportunity. In other words, please carry it on your person at all times. Not 100% of the costs are reimbursed, but your insurance should make up the deficit.

Therefore, it is essential that each guest takes out a travel insurance policy for the entire duration of the trip.

Any information or advice provided by the business on matters such as walking routes, climate, clothing, travel documents, baggage, special equipment, etc., is given in good faith, but without responsibility on the part of the business.

The customer accepts full responsibility for obtaining any necessary visas and travel documents needed to allow them to take a tour with Touraloora.

Touraloora is not liable for any activity which is provided by or availed of through a third party while customers are on any of our tours, e.g. horse riding, cycling, kayaking, boat trips, etc. Nor is the business liable if a customer decides to engage in any activity of their own volition, e.g. swimming, etc.

Health, Fitness & Due Care

Walking is a physically strenuous outdoor activity, often undertaken in remote locations and on uneven ground and thus has an element of risk associated with it.

The customer who books to join an event with the business understands and accepts that there is risk involved. The customer must be confident that they have a level of personal health and fitness sufficient to engage in such activity. Furthermore, the customer confirms that they do not suffer (and have never suffered) from any pre-existing medical condition which would preclude them from participating in such an activity.

All customers must inform the guide, prior to the commencement of any event, if they have any underlying health issues, e.g. suffer from asthma, allergies, etc.

The customer will observe due care at all times and be mindful of their personal safety and that of other members of a group and of the group as a whole. Furthermore, the customer agrees to heed the advice and instructions of the guide in relation to matters of safety, direction, etc, at all times.

The decision of the guide (Angela Gavigan) is final in all matters of route choice, shortcuts to be taken or not, cancellations, modifications, etc, to any tour or event.

Customers are strongly advised to have their own personal health insurance cover.

Jurisdiction

This contract is made on the terms of these booking conditions which are governed by Irish Law and customers shall submit to the jurisdiction of the Irish Courts.

Tour information & Feedback

Our website contains general descriptions of the various tours available, outlining the itinerary and services included in the price. Changes in any or all of these items may need to be made from time to time and the business reserves the right to do so without consulting customers who have booked.

For all tours, a PDF brochure will be emailed to all customers, with further details, additional to what appears on this website.

Our website contains statements representing the honest belief of the business that the facts as shown are correct.

Every reasonable effort has been made to fully describe the tours offered and every reasonable attempt will be made to honour what has been described.

Notwithstanding the above, Touraloora reserves the right to make changes to the information, prices and itineraries set out on the website and such changes shall be binding on the parties.

Likeness / Imagery

Any likeness or images of you secured or taken on any of our tours or any imagery/media which you capture and share with us (e.g. either by email or on social media), may be used by Touraloora, without charge in all media, for bona fide promotional or marketing purposes, including without limitation promotional materials of any kind, such as brochures or on the Internet.

In the interests of continuing to offer the best possible standards of service, Touraloora reserves the right to share, or not to share, any feedback or comments received from you with our business partners, be they accommodation suppliers, luggage transfer providers, taxi drivers, etc. The business commits to only doing this, where your feedback can be useful to our partners to better or improve their service.  Your driver/guide will request to take photos during the tour. These photos may be used online by Touraloora solely for the purpose of marketing our services.  If you do not wish your photos to appear online, please inform your driver guide and we will ensure your wishes are respected.

Luggage

An upper weight limit of 17kg per person, or 1 piece of luggage applies to the luggage allowance on all our tour packages. 1 smaller piece of hand luggage will also be permitted. The business reserves the right to refuse the transfer of loads which exceed either of these limits (number of items and/or weight).

Luggage will not be transferred from or to locations which are outside the tour itinerary you have booked. If you have booked an extra night’s accommodation in a location outside the tour itinerary, your baggage will not be transferred to or from this location.

Neither Touraloora nor its partners (taxi drivers, minibus transfer businesses, accommodation providers, etc.) can accept any liability relating to loss or damage of personal property during your tour. For this reason, valuable or breakable items (e.g. jewellery, electronic devices, cash, cameras, etc.) should not be left in baggage.

Touraloora strongly encourages you to take out adequate insurance cover, prior to travel, for loss or damage to personal property.

Punctuality

As Touraloora Guides are booked each day it is important that all clients must be punctual and arrive/ be ready for collection at the agreed time. If you’re running late for your tour or event, please notify the office at your earliest convenience.

All queries made by phone and email to Touraloora will be replied to within 48 hours where possible. Please note social media may not be checked daily so it is advisable to email or call the office for help with enquiries.

Touraloora reserves the right to not reply to any emails or enquiries that they deem to spam, junk or of a false nature.

Pricing

The hire price is guaranteed to remain the same as quoted at the time of reservation, so long as no alteration has been made to the itinerary after the reservation has been made. Any alterations made to the journey itinerary after the reservation has been made will be charged accordingly.

Quotations are based on the duties outlined by clients and our estimated time to leave from our base to complete the services and return to base. Extra journeys or duties requested by clients on the day, where possible, will be charged at the hourly rate.

Vehicle parking, tolls and fuel costs are included in the price. However, any extra costs incurred on the journey (including parking, tunnel and toll costs requested as extras during the tour and not beforehand) will be charged at cost. If parking fine/tickets are issued to our Guides/vehicles as a result of passenger instructions, then the client named on the booking will incur additional costs to cover these.

The route taken is at the Guide’s discretion. The Guide will take the best possible route and in the event of heavy traffic congestion, he/she will amend the route if necessary and endeavour to deliver passengers to their destination on time. Touraloora do not accept responsibility for any delays, missed appointments or travel arrangements. Always allow plenty of time for your journey.

Amendments to Bookings

Please ensure when booking that the most accurate details are provided. For any subsequent changes after your confirmation has been issued, we will endeavour to make changes if we receive reasonable notification four weeks in advance. Please notify us immediately quoting your reservation number. Any changes of dates, times, transport, attractions or venues may incur a surcharge.

Account Holders

All accounts are billed at the end of each calendar month. Payment should be made within 7 days, unless otherwise agreed. If paying by direct payment a remittance advice stating Invoice number should be sent to Touraloora at info@touraloora.com

Complaints

Touraloora endeavour to meet the highest standards expected by our clients. If, however, you have a complaint at any time during your tour, please inform your Guide immediately. Your Guide is authorised to deal with any problems that can easily be sorted out on the spot. If the problem is not resolved to your satisfaction, please contact  info@touraloora.com

Airport Transfers

If the client fails to arrive at his/her collection point then No Refund will be issued, however every effort will be made to contact the client. If a flight is delayed, your Guide will arrive to the airport at the revised arrival time. If you miss a flight, please contact us immediately.

The first 30 minutes of waiting time is included in the hire price. Thereafter, waiting time will be charged at our basic hourly rate based on our current tariff at the time of journey.

Touraloora will monitor the flight progress based on information available. The Guide shall amend his arrival or departure time accordingly. If however, the flight arrival or departure time changes due to delay, following the Guide’s arrival at the airport, then additional waiting time will be charged at our hourly rate. If, as a result of extreme delays the Guide is required to return to the airport in order to collect the client, then this will be charged. To ensure that a vehicle is available for your late arrival or departure please inform our office as soon as you are aware of any delay to your arrival or departure time.

Children

Touraloora are delighted to provide child seats free of charge for our junior passengers in our vehicles. If a child seat is required for your journey, please ensure that it is requested at the time of booking. It must be checked by the parent/carer of the child and fixed correctly. The parent/carer is responsible for the safety of the child at all times. By Irish Law all passengers 17 years or younger must wear seat belts/restraints during the journey.

Smoking

Touraloora operate a strict No Smoking policy in all our vehicles.

Guide Dogs

We welcome Guide dogs in our vehicles, but they must be declared at the time of reservation.

Damage/Soiling of Vehicles

If any of our vehicles are damaged or soiled as a result of passengers’ actions, we will charge the client fully for the amount to remediate and for time lost whilst the vehicle was taken out of the fleet for remediation.

Disclaimer

Touraloora do not accept responsibility for the following: delays due to adverse weather conditions; Loss or damage of any item belonging to any of the passengers traveling in our vehicles unless caused by a member of our staff; delays caused by road traffic accidents; other traffic conditions or acts of God; any passenger leaving possessions or items in the vehicle does so at their own risk.

Liability

Touraloora is pleased to accept full responsibility for arranging with reasonable skill and attention any tour or service booked with us. However, we are not responsible for the day to day running of the various hotels and attractions not under our direct control. Accordingly, Touraloora wish to make it perfectly clear that we accept no responsibility for any additional expense, distress, disappointment, loss, damage, injury, accident, delay, irregularity, or inconvenience, resulting from or arising from the act or default of any company, firm or persons in connection with the carrying out of such arrangements or bookings or conveyance of any of our clients. Every booking is accepted subject to the conditions imposed by the relevant hotel, attraction, transport service, restaurant, company or persons. Any claim in respect to such matters must be made against the appropriate principal.

Gratuities

Gratuities are at the client’s discretion and are not included in the price. The consideration for the guides gratuity would be based on punctuality, service, guiding and any additional hours they might do. Gratuities are usually paid directly to the Guide. If the client wishes they may charge a gratuity payment to their card.

Tipping in restaurants is similar to the US & Canada. 10-15% is normal. When the bartenders/waiters/waitress bring drinks to where you are seated, the tip is approx 2 to 3 euros.

In Ireland, we tend to hand gratuities to our server rather than leave a tip on a table. Gratuities are normally paid in cash to your server, and not included on your credit card.

Contract of Service

When you order services from us, the terms in force at the time of your order will apply as the contract of sale between you and us.  This contract of sale begins to be formed between us when we issue an invoice. You shall only become the full owner of the service once we have received full payment for it.

Social Media Platforms

Communication, engagement, and actions taken through external social media platforms that we participate on are custom to the terms as well as the data protection and privacy policies and notices held with each social media platform respectively.  You are advised to use social media platforms wisely and communicate / engage upon them with due care and caution regarding your own privacy and personal details.  We will never ask for personal or sensitive information through social media platforms and encourage you when wishing to discuss sensitive details to contact us through primary communication channels such as by telephone or email.

Data Protection, Privacy and Security

Your rights to data protection and privacy, including security over data, are very important to us.  We treat personal data obtained using this website as private and are committed to providing you with secure access to our online service.  This website processes information from you as per our Privacy Statement.  When you, amongst other actions, visit our website, enquire about services or send e-mails to us you understand that subsequent data processing will be done as detailed in our Privacy Statement.

Governing Law and Disputes

This website is hosted, controlled, and operated from the Republic of Ireland and therefore governed by Irish law, subject to the terms of Public International Law.  In the event of any dispute of any nature whatsoever arising between the parties on any matter provided for in, or arising out of this agreement, the Irish law will apply and the appropriate courts of the Republic of Ireland will have jurisdiction.

Variation of these Terms and Conditions

We reserve the right to make changes to this website, these terms, and the other information contained in this website at any time and without notice.  Please refer to these terms when you visit the website as they may change from time to time.

Waiver

The failure of us to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision.

Entire Agreement

These terms and any policies or operating rules posted by us on this website or in respect to our website constitutes the entire agreement and understanding between you and us and govern your use of the website, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of these terms).  Any ambiguities in the interpretation of these terms shall not be construed against the drafting party.
